Terms of Service

Article 1 (Application)

These Terms of Service (these “Terms”) are intended to set forth the rights and obligations between the operator of SkyBeMoreBlue (the “Service”) (the “Operator”) and users who use the Service, and shall apply to all relationships between users and the Operator regarding the use of the Service.

Article 2 (User Registration)

The Service uses AT Protocol (Bluesky) accounts for authentication. Users shall create accounts in accordance with AT Protocol’s terms of service and use the Service accordingly.

Users who apply for user registration shall be deemed to have agreed to these Terms.

Article 3 (Management of User ID and Password)

Users shall properly manage their Service user ID and password (AT Protocol account) at their own responsibility.

Users may not, under any circumstances, transfer or lend their user ID and password to third parties, or share them with third parties.

Article 4 (Usage Fees and Payment Methods)

The Service is currently provided free of charge. If paid plans are introduced in the future, we will notify users in advance.

Article 5 (Prohibited Activities)

Users shall not engage in any of the following activities when using the Service:

  • Acts that violate laws or public order and morals
  • Acts related to criminal activities
  • Acts that destroy or interfere with the functions of the Operator’s, other Service users’, or third parties’ servers or networks
  • Acts that commercially exploit information obtained through the Service
  • Acts that may interfere with the operation of the Operator’s services
  • Acts that collect or accumulate personal information about other users
  • Acts of unauthorized access or attempts thereof
  • Acts of impersonating other users
  • Advertising, promotion, solicitation, or business activities on the Service not authorized by the Operator
  • Acts aimed at meeting strangers of the opposite sex
  • Acts that constitute stalking or harassment of other users
  • Other acts that the Operator deems inappropriate

Article 6 (Suspension of Service Provision)

The Operator may suspend or interrupt the provision of all or part of the Service without prior notice to users if any of the following reasons are determined to exist:

  • When performing maintenance, inspection, or updates of the computer system related to the Service
  • When provision of the Service becomes difficult due to force majeure such as earthquakes, lightning, fires, power outages, or natural disasters
  • When computers or communication lines stop due to accidents
  • Other cases where the Operator determines that provision of the Service is difficult

Article 7 (Usage Restrictions and Registration Deletion)

The Operator may, without prior notice, restrict users’ use of all or part of the Service or delete their registration if users fall under any of the following:

  • Violation of any provision of these Terms
  • Discovery of false information in registration details
  • Default on payment obligations for fees
  • Failure to respond to communications from the Operator for a certain period
  • No use of the Service for a certain period since the last use
  • Other cases where the Operator determines that use of the Service is inappropriate

Article 8 (Withdrawal)

Users may withdraw from the Service through withdrawal procedures designated by the Operator.

Article 9 (Disclaimer of Warranties and Limitation of Liability)

The Operator makes no express or implied warranties that the Service is free from factual or legal defects (including defects, errors, bugs, rights infringements, etc., related to safety, reliability, accuracy, completeness, effectiveness, fitness for specific purposes, security, etc.).

The Operator assumes no responsibility for any damages incurred by users arising from the Service.

Article 10 (Changes to Service Content)

The Operator may change the content of the Service or discontinue provision of the Service without notifying users, and assumes no responsibility for damages incurred by users as a result.

Article 11 (Changes to Terms of Service)

The Operator may change these Terms at any time without notifying users when deemed necessary. If users begin using the Service after changes to these Terms, such users shall be deemed to have agreed to the changed Terms.

Article 12 (Handling of Personal Information)

The Operator shall appropriately handle personal information acquired through use of the Service in accordance with the Operator’s “Privacy Policy.”

Article 13 (Notifications and Communications)

Notifications and communications between users and the Operator shall be conducted through methods designated by the Operator. Unless the Operator receives notice of changes in the manner separately designated by the Operator, the Operator shall deem currently registered contact information to be valid and send notifications or communications to such contact information, which shall be deemed to have reached users at the time of transmission.

Article 14 (Prohibition of Transfer of Rights and Obligations)

Users may not transfer their position under the usage agreement or rights or obligations under these Terms to third parties, or use them as collateral, without the Operator’s prior written consent.

Article 15 (Governing Law and Jurisdiction)

These Terms shall be governed by Japanese law. In the event of disputes arising in connection with the Service, the Tokyo District Court shall have exclusive agreed jurisdiction.
